2. Acceptance of Terms

By accessing or using the Catecut website or Services, you agree to be legally bound by these Terms. If you do not agree, you must not use the Services.

If you are using the Services on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

3. Description of Services

Catecut provides digital, data-driven and AI-powered services for fashion, retail, and e-commerce businesses, including but not limited to:

Automated product tagging and enrichment

Metadata generation

Product descriptions and structured attributes

Fashion and retail analytics

AI-generated insights and recommendations

API-based and platform-integrated services

Catecut does not sell physical products, does not operate a marketplace, and does not act as a retailer, reseller, or affiliate seller.

All services are delivered electronically via the website, dashboards, APIs, exports, or integrations.

4. Website Availability and Access

The Services are provided exclusively through https://catecut.com/ and associated web-based interfaces, including the Catecut dashboard.

Catecut may update, modify, suspend, or discontinue any part of the Services at any time without liability.

5. Eligibility

To use the Services, you must:

Be at least 18 years old

Have legal capacity to enter into a binding agreement
Use the Services in compliance with applicable laws

6. Accounts and Security

Some Services require account registration. You are responsible for:

Maintaining the confidentiality of login credentials

All activity under your account

Providing accurate and current information

Catecut may suspend or terminate accounts for security reasons, misuse, or breach of these Terms.

7. Pricing and Payment

Pricing for Catecut services is provided via quotation, order form, or commercial agreement prior to purchase.

Prices are exclusive of applicable taxes unless stated otherwise

Fees are payable in advance unless agreed otherwise

Catecut may update pricing at any time, but changes will not apply retroactively to already paid periods

Failure to pay may result in suspension or termination of access.

8. Service Delivery

Catecut provides digital services only. Delivery occurs electronically and may include:

Platform or dashboard access

API credentials

Data outputs, reports, or exports

AI-generated content

Access is typically granted immediately or within a reasonable timeframe following successful payment and setup.

No physical goods are shipped.

9. Refunds and Cancellations

Unless otherwise agreed in writing:

Subscriptions may be cancelled in accordance with the billing terms presented at checkout

Fees already paid for the current billing period are non-refundable

Refunds may be issued at Catecut’s discretion in cases of billing errors, duplicate charges, or failure to deliver the agreed service

If a separate Refund and Cancellation Policy is published on the website, it forms part of these Terms.

10. Customer Obligations

You agree to:

Use the Services lawfully and in accordance with these Terms

Ensure you have rights to any data you submit

Not misuse, resell, or reverse engineer the Services

Not interfere with or disrupt the Services or systems

Catecut may suspend or terminate access for violations without refund.

11. Intellectual Property

All software, models, algorithms, interfaces, designs, documentation, trademarks, and content provided by Catecut (“Content”) are owned by or licensed to Sowilo ehf.

You are granted a limited, non-exclusive, non-transferable right to use the Services during the term of your subscription. No ownership rights are transferred.

Unauthorized copying, modification, or distribution is prohibited.

12. Data, Inputs, and Outputs

You retain ownership of data you provide (“Input Data”). You grant Catecut a limited right to process Input Data solely to provide and improve the Services.

Service outputs may be automated, probabilistic, or inferential and are provided “as is”. Catecut does not guarantee accuracy, completeness, or suitability for any specific purpose.

13. Third-Party Services

The Services may integrate with or reference third-party platforms or tools. Catecut is not responsible for third-party services, content, or availability.

Use of third-party services is governed by their own terms.

14. Disclaimer

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Catecut does not warrant uninterrupted or error-free operation.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Catecut shall not be liable for indirect, incidental, consequential, or punitive damages

Catecut’s total liability shall not exceed the fees paid by you in the 12 months preceding the claim

Your use of the Services is at your own risk.

16. Indemnification

You agree to indemnify and hold harmless Sowilo ehf from claims arising out of:

Your misuse of the Services

Breach of these Terms

Violation of applicable laws
Data you submit without proper rights

17. Termination

Catecut may suspend or terminate access at any time for breach or misuse. Upon termination, provisions relating to intellectual property, disclaimers, liability, and governing law survive.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of Iceland. Any disputes shall be subject to the exclusive jurisdiction of Icelandic courts.

19. Accessibility of Terms

These Terms and any applicable pricing or refund policies are clearly accessible on https://catecut.com/ prior to purchase and during use of the Services.
